TERMS OF USE FOR DART DELIVERS IN BRUNEI

These Terms and Conditions ("Terms") govern your use of Dart Delivers, a delivery service provided through the Dart mobile application operated by Dart Logistics Sdn Bhd ("Dart", "we", "our", or "us").
By using Dart Delivers, you agree to be bound by these Terms and Conditions.
1. Eligibility
1.1 You must have a valid Dart account to use Dart Delivers.
1.2 You may only use your own account and must not allow others to use your account.
1.3 You agree to comply with all applicable laws and regulations when using Dart Delivers.
2. Service Description
2.1 Dart Delivers is an on-demand delivery service connecting users with independent drivers through the Dart platform.
2.2 Drivers providing delivery services through the Dart platform are independent service providers and are not employees, agents, or representatives of Dart.
2.3 Dart does not guarantee the availability of drivers at all times.
2.4 Estimated delivery times are provided for reference only and are not guaranteed.
3. Package Requirements
3.1 Standard Delivery
Maximum dimensions: 50cm (L) × 25cm (W) × 25cm (H), Maximum weight: 10kg.
3.2 Dart Delivers XL
Maximum dimensions: 100cm (L) × 50cm (W) × 50cm (H), Maximum weight: 30kg.
3.3 Dart reserves the right to refuse, reject, or cancel any booking that exceeds the permitted dimensions or weight limitations.
6. Prohibited Items
Illegal goods, drugs and narcotics, firearms and ammunition, explosives, hazardous materials, dangerous chemicals, counterfeit goods, tobacco products, vapes, alcohol, cash, precious metals, valuable jewellery, live animals, human remains, and any item prohibited by the laws of Brunei Darussalam.
Dart reserves the right to reject, inspect, or cancel any booking involving suspected prohibited items.
7. Right of Inspection
7.1 Dart and its drivers reserve the right to inspect any package where reasonably necessary to verify compliance with these Terms.
7.2 Refusal to permit inspection may result in cancellation of the delivery request.
7.3 Dart reserves the right to report suspected illegal activities or prohibited items to the relevant authorities without prior notice.
87. Packaging Responsibility
8.1 Users are solely responsible for ensuring that all items are properly packaged, secured, and suitable for transportation.
8.2 Dart shall not be liable for any loss or damage resulting from inadequate packaging.
8.3 Drivers may refuse to transport packages that appear damaged, improperly packed, leaking, unsafe, or unsuitable for transport.
9. Delivery Responsibilities
9.1 Users are responsible for providing accurate sender and recipient information.
9.2 Users must ensure that both sender and recipient are contactable throughout the delivery process.
9.3 Drivers may contact the sender or recipient to verify delivery details.
9.4 If the package is not ready for collection upon the driver's arrival, the driver may cancel the booking.
10. Failed Deliveries and Returns
10.1 If the recipient cannot be contacted, located, or refuses to accept the delivery, the delivery may be deemed unsuccessful.
10.2 Dart may arrange for the package to be returned to the sender.
10.3 Return charges shall be charged at the applicable delivery rate.
10.4 Additional charges may apply where reasonable efforts have already been undertaken to complete the delivery.
11. Waiting Time and Cancellations
11.1 Drivers may cancel a booking if the package is not ready upon arrival, differs materially from the description provided, contains prohibited items, or if the sender or recipient cannot be contacted after reasonable attempts.
11.2 If a booking is cancelled after the driver has arrived at the pickup location, applicable cancellation fees may apply.
11.3 Dart reserves the right to charge cancellation fees where reasonable costs have already been incurred.
12. Payment
12.1 Payment for Dart Delivers shall be made exclusively through Dart Credits.
12.2 Users are responsible for ensuring sufficient balance or valid payment methods before placing an order.
12.3 Additional bank charges, card processing fees, or foreign transaction fees imposed by financial institutions shall be borne by the user.
13. No Insurance Coverage
13.1 Dart Delivers does not provide insurance coverage for items in transit.
13.2 Users acknowledge and accept all risks associated with sending items through the service.
13.3 Users should make alternative insurance arrangements for valuable items where required.
14. Limitation of Liability
14.1 To the maximum extent permitted by law, Dart shall not be liable for loss of profits, loss of revenue, indirect losses, consequential losses, special damages, or loss or damage arising from delays beyond Dart's control.
14.2 Dart's total liability arising from any delivery shall not exceed the delivery fee paid for that specific booking.
14.3 Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
15. Proof of Delivery
15.1 Dart may use delivery photographs, GPS records, driver records, in-app delivery status, and recipient confirmation as proof of delivery.
15.2 Such records shall be deemed sufficient evidence that delivery has been completed.
16. Force Majeure
Dart shall not be responsible for delays, interruptions, or failure to perform its obligations arising from circumstances beyond its reasonable control, including severe weather, floods, fires, road closures, traffic accidents, government actions, civil disturbances, technical failures, network outages, and natural disasters.
17. Privacy
17.1 Users must ensure they have obtained consent from recipients before sharing recipient information with Dart.
17.2 User and recipient information may be shared with drivers solely for the purpose of facilitating delivery.
17.3 Dart shall process personal information in accordance with its Privacy Policy.
18. Suspension and Termination
18.1 Dart reserves the right to suspend, restrict, or terminate access to Dart Delivers at any time where these Terms are breached, fraudulent activity is suspected, illegal activity is suspected, or misuse of the service is detected.
18.2 Dart may investigate any suspected misuse of the platform.
19. Indemnity
Users agree to indemnify and hold harmless Dart, its directors, officers, employees, affiliates, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from breach of these Terms, violation of applicable laws, delivery of prohibited items, inaccurate information provided by the user, or misuse of the service.
20. Governing Law and Dispute Resolution
20.1 These Terms shall be governed by and construed in accordance with the laws of Brunei Darussalam.
20.2 Users agree to first attempt to resolve any dispute through Dart Customer Support.
20.3 Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Brunei Darussalam.
21. Amendments
21.1 Dart reserves the right to amend, update, or modify these Terms and Conditions at any time.
21.2 Updated Terms shall take effect upon publication through the Dart platform or Dart website.
21.3 Continued use of Dart Delivers constitutes acceptance of the updated Terms.
